3. Legal Status of
foster child (adotive child) in Case of Inheritance According to Al-Qasimi
Recalling
back related with the definiton of adoption versional-Qasimi, as has been I
(
the author) said above, that the adopted child or foster chlid
will forever remain
a foster child or adoptive chlid
and will never change of his status become a biological child. This is because that child
adoption or foster child
is created from seed his own father, and
a child impossible be born of the seed of two men by way of contributions each
other.
The
lack of this status change certainly will implies no change in a mahram law occur between adoptive family with adopted children. So if
the adopted child has reached
to age of adulthood, then it has become imperative for the
adoptive family to cover his
nakedness, because basically adopted child foster
chlid is not a mahram for adoptive family.
There is no relation of biological or lineage between them. The relationship between them is simply mutual
help between the two families, in which one
of them need each other.
Causally the lack of a mahram relationship
between adoptive familiy with adopted child, where the mahram relationship
which is a main factor of a right to mutual inherit each other, then the
adoptive familiy with adopted child will not be able to mutual inherit each other. However, to overcome
this, Islam has provided a solution, it is giving testament to the adopted child with no
exceeding of thirds.
